Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and XTRK PTE. LTD., a private company limited by shares incorporated in the Republic of Singapore (the "Company", "PiggyTRK", "we", "us"), the operator of the PiggyTRK service. The Service is offered at piggytrk.com and via any related applications, APIs, and content (the "Service").

By creating an account, paying for a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Eligibility and accounts

1.1 Adult parents only. To create a PiggyTRK account you must be at least eighteen (18) years old (or the age of majority in your jurisdiction, if higher), have legal capacity to enter into a binding contract, and use the Service in compliance with applicable law.

1.2 Family setup. The adult who creates an account is the "Parent". The Parent may create accounts for their own children ("Children") and invite a co-parent. The Parent is responsible for: (a) obtaining any consent required to create a Child account in their jurisdiction; (b) supervising the Child's use of the Service; and (c) all activity under their family.

1.3 Account credentials. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly at hello@xtrk.ai of any unauthorised use.

1.4 One Service, one truth. We may suspend or terminate accounts that are duplicates, fictitious, used to impersonate another person, or created in breach of these Terms.

2. The Service

2.1 What PiggyTRK is. PiggyTRK is a family-economy education tool. It lets a Parent run an in-app currency ("Piggy Bucks") for their family, assign chores, approve withdrawals, set a family tax goal, simulate investments, and offer optional educational features.

2.2 What PiggyTRK is not. PiggyTRK is not a bank, a money services business, a payment institution, an investment adviser, a broker-dealer, a custodian, a securities issuer, or a tax adviser. Piggy Bucks are an in-app educational unit and do not represent real currency, legal tender, e-money, securities, derivatives, deposits, or any financial instrument. Nothing in the Service constitutes financial, investment, tax, or legal advice.

2.3 Updates. We may add, change, or remove features at any time, provided that we will not materially reduce the core family-economy functionality (Parent dashboard, kid app, chores, allowance, withdrawals, ledger) during a paid period without offering you a pro-rata refund for the unused portion of the affected period.

3. Subscription, free trial and billing

3.1 Single plan with a free trial. The PiggyTRK service is offered on a single subscription plan, with a seven (7) day free trial that begins when you select the plan. After the trial, the subscription renews automatically at the then-current rate (currently US$8.98 per month, or US$83.76 per year, as displayed at checkout) until cancelled.

3.2 Card on file. A valid payment method is required to start the trial. You authorise us (and our payment processor, Stripe, Inc.) to charge that payment method for the subscription fee on each renewal date until you cancel.

3.3 Cancellation. You may cancel at any time, with no cancellation fee, from your account's Subscription page or by writing to hello@xtrk.ai. Cancellation takes effect at the end of the then-current billing period; you will retain access to the paid features until then.

3.4 Refunds. Subscription fees are charged in advance and, except as required by Singapore law or expressly provided in these Terms, are non-refundable. If you believe you have been billed in error, please contact us within sixty (60) days and we will investigate in good faith. Hardship waivers are available; see Section 3.6.

3.5 Taxes. Fees are quoted exclusive of GST and other taxes that may apply. Where required, we will add applicable taxes at the prevailing rate.

3.6 Hardship. If paying for the Service would create real hardship for your family, write to hello@xtrk.ai. We grant hardship waivers without proof and without limit.

3.7 Price changes. We may change the subscription price on at least thirty (30) days' notice by email. If you do not wish to accept the new price, you may cancel before it takes effect.

3.8 Failed payment. If a renewal payment fails, we will retry collection a small number of times and email you. If the payment is not collected, your subscription will pause and the family will be locked to the billing screen until payment is restored. Pending kid activity continues to be saved during a pause; nothing is lost.

4. Acceptable use

You agree not to:

  • Use the Service in violation of any law, regulation or third-party right.
  • Use the Service to harass, threaten, defraud, or harm any person, including any child.
  • Upload content that is unlawful, defamatory, obscene, infringing, or that constitutes child sexual abuse material.
  • Attempt to gain unauthorised access to any account, family, system or data, including by probing, scanning, or testing the vulnerability of the Service except as expressly permitted by our vulnerability disclosure programme.
  • Reverse engineer, decompile, or disassemble the Service, except to the extent expressly permitted by law.
  • Interfere with the integrity or performance of the Service or the data contained in it (rate-abuse, denial of service, spam, automated scraping).
  • Use the Service to develop a competing product, or to train any machine-learning model on data extracted from the Service.
  • Resell, sublicense or redistribute the Service or any data obtained from it without our prior written consent.

We may suspend, restrict or terminate access for any breach of this Section 4, with or without prior notice depending on severity.

5. Your content and licence to us

5.1 You own your content. You retain all rights you have in any content you upload to the Service (chore titles, goal text, family chat messages, avatars, etc.) ("Your Content").

5.2 Limited licence to operate the Service. You grant us a worldwide, non-exclusive, royalty-free licence, for the duration of your account, to host, copy, transmit, display and modify Your Content solely as needed to operate, secure and improve the Service for you and your family. This licence ends when you delete the relevant content or your account, except for backups retained for the short period described in our Privacy Policy.

5.3 No training without consent. We do not use Your Content (and we never use Child personal data) to train artificial-intelligence models, except for content you expressly opt-in to share for that purpose, if and when we offer such an option.

5.4 Feedback. If you send us suggestions or feedback, we may use them without restriction. We will not attribute feedback to you publicly without your permission.

6. Our intellectual property

The Service, including all software, text, graphics, audio, video, logos, the "PiggyTRK" name, the Piggy Buck symbol, the kid character set, and any other content we provide, is owned by us or our licensors and is protected by copyright, trade-mark, and other intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your family's personal, non-commercial use, subject to these Terms.

7. Children using the Service

7.1 Parental responsibility. The Parent is responsible for the Child's use of the Service, including reviewing chore submissions, withdrawal requests, loan requests, and family-chat messages.

7.2 Piggy Bucks. The in-app "Piggy Bucks" currency is a learning tool. Any money the Parent chooses to disburse to the Child outside the Service is a private decision between the Parent and the Child; PiggyTRK is not party to that arrangement and does not facilitate the transfer of real funds to the Child.

7.3 No advertising. We do not show advertisements to a Child and do not allow third-party advertising trackers on the kid surface.

7.4 Removal. A Parent may remove a Child account at any time from the family settings. Doing so archives or deletes the Child's data in line with our Privacy Policy.

8. Service availability and changes

8.1 Reasonable efforts. We use commercially reasonable efforts to keep the Service available. We do not, however, commit to a specific uptime percentage and we do not provide service-credits for downtime. Maintenance, outages, third-party provider failures and force majeure events may from time to time interrupt the Service.

8.2 Beta features. We may label some features as beta, preview or experimental. Such features are provided as-is and may be modified, suspended, or discontinued at any time without notice.

8.3 Service discontinuation. If we decide to discontinue the Service in your country, we will give you at least ninety (90) days' notice and a way to export your family data.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties or conditions of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, quiet enjoyment, or that the Service will be uninterrupted, secure, or error-free.

Nothing in this Section limits or excludes any liability that cannot be limited or excluded by Singapore law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any non-excludable statutory consumer rights.

10. Limitation of liability

10.1 No indirect or consequential loss. To the maximum extent permitted by law, neither party will be liable to the other for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or anticipated savings, however caused.

10.2 Cap. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), under statute, or otherwise, will not exceed the greater of: (a) the subscription fees you actually paid us in the twelve (12) months immediately preceding the event that caused the claim; or (b) one hundred Singapore dollars (S$100).

10.3 Carve-out. The disclaimers and limitations in Sections 9 and 10 do not apply to liability that cannot be excluded or limited under applicable law.

11. Indemnity

You agree to indemnify, defend and hold harmless PiggyTRK, its directors, employees, and authorised representatives, from and against any third-party claim, loss, liability, cost or expense (including reasonable legal fees) arising out of (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) Your Content. We will tell you promptly of any such claim, give you reasonable cooperation, and not settle without your prior written consent (not to be unreasonably withheld).

12. Suspension and termination

12.1 By you. You may close your account at any time via the Subscription page or by writing to us at hello@xtrk.ai.

12.2 By us. We may suspend or terminate your access to the Service, with or without notice, if (a) we reasonably believe you have breached these Terms; (b) payment fails and is not restored; (c) we are required to do so by law or a court order; or (d) we discontinue the Service in your country.

12.3 Effect. On termination, your right to use the Service ends immediately. Sections 5.1, 5.2, 5.4, 6, 9, 10, 11, 13, 14 and 15 survive termination, together with any other provision that by its nature should survive.

13. Changes to these Terms

We may revise these Terms from time to time. The "Effective date" at the top of this page reflects the latest revision. If a revision materially changes your rights or obligations, we will give you at least thirty (30) days' notice by email and inside the Service. If you do not accept the revised Terms, you may cancel your subscription before they take effect; continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing law and dispute resolution

14.1 Governing law. These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of the Republic of Singapore.

14.2 Forum. The courts of Singapore have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Service, save where applicable mandatory consumer-protection laws confer jurisdiction on the courts of your place of residence.

14.3 Informal resolution first. Before initiating proceedings, you agree to write to legal@piggytrk.com with a concise description of the dispute and to allow us thirty (30) days to attempt to resolve it amicably.

14.4 Consumer protection. Nothing in these Terms displaces non-excludable rights you may have as a consumer under the Consumer Protection (Fair Trading) Act, the Sale of Goods Act, the Unfair Contract Terms Act, or other applicable consumer-protection statutes.

15. General

15.1 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us with respect to the Service and supersede any prior or contemporaneous agreements, communications and proposals.

15.2 No assignment by you. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of all or a substantial part of our business, provided that the assignee assumes our obligations.

15.3 Severability. If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

15.4 Waiver. A failure or delay by either party in enforcing any right under these Terms is not a waiver of that right.

15.5 Notices. We may give notices by email to the address on file for your account or by an in-app message. You may give us notices at legal@piggytrk.com.

15.6 Force majeure. Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of government, war, civil unrest, natural disasters, internet or third-party service failures, and pandemic.

15.7 Third parties. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any term of these Terms.

15.8 Language. These Terms are written in English. The English version is authoritative; any translation is provided for convenience only.
